These Terms and Conditions ("Terms") govern your access to and use of the Inspectsnap mobile application, the related website, and any associated services (collectively, the "Service") provided by Inspectsnap Inc. ("Inspectsnap," "we," "our," or "us"). Please read these Terms carefully. By creating an account, purchasing a subscription, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not access or use the Service.
You represent that you (a) are at least 18 years old; (b) hold any license or certification required under Florida law to perform the inspections you conduct; and (c) will comply with all applicable statutes, regulations, and building‑code requirements, including but not limited to Florida Statutes § 627.711 (Wind Mitigation) and § 553.844.
You must provide accurate, current information (e.g., legal name, license number) and keep it updated. You are responsible for safeguarding your login credentials and all activity that occurs under your account.
Subscriptions recur automatically until canceled. Fees, billing dates, and renewal terms are displayed at checkout. Taxes are your responsibility. You authorize our payment processor (e.g., Stripe) to charge your selected payment method. All fees are non‑refundable except as required by law.
Subject to these Terms, Inspectsnap grants you a limited, non‑exclusive, non‑transferable, revocable license to install and use one copy of the App on a device you own or control solely for your professional inspection activities. You may not (i) reverse engineer or decompile the App; (ii) sublicense, sell, or lease the Service; (iii) remove proprietary notices; or (iv) interfere with security‑related features.
You retain all ownership rights in Inspection Data. You grant Inspectsnap a worldwide, royalty‑free license to host, store, reproduce, and display Inspection Data solely to provide the Service and generate reports you request. You are responsible for obtaining any required homeowner consent to collect and disclose personal information.
The Service, including all software, text, graphics, and logos (excluding your Inspection Data), is owned by Inspectsnap or its licensors and is protected by U.S. and international intellectual‑property laws. Except for the limited license in § 5, no rights are granted.
The Service may integrate with third‑party services (e.g., cloud drives, CRM software). Use of those services is governed by their own terms. Inspectsnap is not responsible for third‑party content or practices.
You agree not to: (a) upload malicious code; (b) use the Service for unlawful or fraudulent purposes; (c) infringe the intellectual‑property or privacy rights of others; (d) attempt unauthorized access to any part of the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." INSPECTSNAP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. We do not warrant that the Service will be continuous, error‑free, or that Inspection Data will be secure or not lost.
To the maximum extent permitted by law, Inspectsnap shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service. Our total liability shall not exceed the greater of (a) amounts you paid to us in the 12 months preceding the claim or (b) $500.
You agree to indemnify, defend, and hold harmless Inspectsnap and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorneysʼ fees) arising out of or related to (i) your Inspection Data; (ii) your violation of these Terms or any law; or (iii) your inspections or reports.
These Terms remain in effect while you access the Service. We may suspend or terminate your account at any time for violations of these Terms. Upon termination, your right to use the Service ceases, but §§ 6‑12 and 15‑18 survive.
These Terms are governed by the laws of the State of Florida, without regard to its conflict‑of‑laws rules. Arbitration. Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Rules in Miami‑Dade County, Florida. Judgment on the award may be entered in any court of competent jurisdiction. You and Inspectsnap waive any right to a jury trial or to participate in a class action.
We may modify these Terms by posting a revised version in the App or on our website and updating the "Last updated" date. Material changes will be announced at least 30 days in advance. Continued use after the effective date constitutes acceptance.
By tapping "Accept" or by using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.
